1. What Personal Information Do We Gather About You?

When you use any of Crypto Capital GmbH Services, among other actions, by browsing our website, uploading our mobile applications, providing registration details, ordering a subscription for any of our digital products, or otherwise interacting with our Services, we gather your personal information. Personal information is the information that identifies you as an individual, a customer or a representative of any company. Several types of personal information can be gathered by us when you interact with our Services, depending on the type of product or service you use. Collection of personal information is necessary for delivering our Services to you and for enhancing of your experience from the use of our Services. 1.1 Through our Services.

(i) General Information: When you access or use any of our Services, we collect some general information about you with the help of essential, “first-party” Cookies. This information includes the type of your web browser, the operating system used, the domain of your Internet provider and similar. This information is needed to correctly deliver the contents of our Services to you and is standard for the use of the Internet. (ii) Registration: When you register at any of our Services, we collect your personal information, such as your name and/or the name of a company you represent, your or your company’s address, telephone number and e-mail address.

(ii) Billing/Subscription: When you subscribe to, or enable payment for any of our paid Services, we collect your name, address, telephone number, email address, credit or debit card information and other billing information, which we use to provide you with the requested Services and to receive your payments for them.

(iii) User-Generated Content When you submit to our Services any of the allowed user-generated content, including registration forms, contact formulas, or emails, your personal information is collected.

(iv) User Experience, or Market Research: When you interact with our interactive programs, answer questionnaires, provides us with your feedback, participate in voluntary surveys conducted via our Services, we collect personal information about you. 1.2 From Other Sources.

For the implementation of some of our Services and for data analytic purposes, we require your information from joint marketing third parties, websites or platforms, such as Bitmex, Coinbase, Binance and other. In order to be able to use some of our Services, you will need to provide us with API keys to your data from these third parties.

2. What Do We Do With The Personal Information We Collect About You?

We collect, use or otherwise process your personal information as allowed under applicable law and based on one, or more of the following:

  • The consent you provide to us at the point of collection of your personal information;
  • The performance of the Agreement, or Contract we have with you;
  • The compliance of a legal obligation to which we are subject;
  • The legitimate interests of Crypto Capital GmbH. "Legitimate interest" is a term, which means that there are good reasons for the processing of your personal information, and measures are taken to minimize the impact on your privacy rights and interests. "Legitimate interest" also refers to our use of your data in ways you would reasonably expect and that have a minimal privacy impact. 3. With Whom Do We Share The Personal Information We Gather?

Crypto Capital GmbH uses your general and personal information ONLY for the internal use and for the implementation of the company’s purposes. Your personal information may be shared within Crypto Capital GmbH or with the Company’s stakeholders or service providers (“service providers”) working on behalf of the Company, on such services as billing or processing your credit-card payments, managing and developing the technology behind our Services, data processing and analytics, providing you with customer service, advertisement, emails, research surveys, focus group management and analysis, or promotions management. In the course of performing of these services, we and our internal or external service providers have access to your data including your personal information.

    • (a) comply with the law or with legal process;

4. Other Information We Collect

Other information does not specifically identify you, and is collected through technology, i.e. automatically. It includes tracking information collected by us.

We use such internet technologies as cookies to track, manage and improve the use of our Services. We use this information for the implementation of the Company’s purposes and under applicable law. Information that we collect using these technologies is combined with your personal information, and is treated as such.

(i) Device Information: We collect information about the computer, mobile or other devices you use to access our Services, such as Internet protocol addresses (IP - the region or general location where your computer or device is accessing the Internet), geolocation information, unique device identifiers, browser type, browser language and other transactional information.

(ii) Cookies, Beacons, Local Storage and Other Similar Technologies: We use “Cookies” - Web beacons, tags and scripts, and other similar technologies including local storage objects. These technologies allow us to manage your access to and use of our Services, to recognize you and personalize our Services for you. You will not be able to access certain areas of our website or some of our Services or Products, if your computer does not accept cookies from us. Since there is no accepted standard on how to respond to “do not track” browser-based signals, we do not respond to such signals. We may transmit your website usage information collected by our Cookies to third parties, in order to show you advertising for Crypto Capital GmbH when you visit other sites or platforms. (iii) Analytics, Log Files and Browsing History: As is true of most websites, we gather certain information automatically and store it in log files. This information include IP address, browser type, operating system, the history of the pages you viewed on our Services, and other usage information about your use of our Services. We automatically combine this collected log-information with other information we collect about you. We do this to improve the Services we offer you, including customized recommendations or advertising; to improve marketing; and to track your access and use of our Services across your devices. For these purposes we DO NOT use third-party analytics services, but our own, internal Crypto Capital GmbH analytics.

(iv) Location Information: Some of our Services, including mobile applications, can deliver content based on your current location. If you enable the location-based feature, your current location will be stored locally on your device, which will then be used by our mobile application(s). If you elect to have a location-based search saved to your history, we will store that information on our Server. If you do not enable the location-based service, or if our application does not have that feature, the application will not transmit to us, and we will not collect or store your location information.

5. How Do We Collect and Use Your Trading Data?

With your consent and permission, Crypto Capital GmbH collects, stores and uses your and/or your company’s trading data for the duration of time that we need for the implementation of our goals and Services. By sharing with us the API keys to your trading data from any of the third party websites or platforms (such as Bitmex, Coinbase, Binance and others) you give us the appropriate consent and permission. After you grant us access to your trading data, we store these data on our Company’s server in AWS data center (Frankfurt, Germany) for the amount of time needed for the implementation of the Company’s Services. Your permission and sharing your data with us give us the license and right to use, analyze, encrypt, encode, transmit, create derivative works of, host, index, cache, tag, and adapt (e.g. to streaming, downloading, mobile or digital scanning or other technologies) your trading data in any form for the Company’s purposes and under regional data protection law. These data are used by Crypto Capital GmbH primary for statistical and analytical purposes, and for providing YOU, your company or other fleet operators and our customers with DATA REPORTS, in accordance with the goals and obligations of our Company.

You can revoke your consent for the use of your trading data by Crypto Capital GmbH at any time with effect for the future by sending us an e-mail at info@cryptocapital.ai. However, for the reason that your trading data is and will be used by Crypto Capital GmbH for statistical and analytical purposes, in case of revocation of your consent, the Company will ANONYMIZE your trading data and CONTINUE THEIR USE for the implementation of our goals and Services. By sharing with us the API keys to your data from any of the third party websites or platforms you agree with our Terms of use of your trading data. 6. Third-Party Websites and Platforms

For your convenience and the implementation of our Company’s goals, our Services contain links to other websites or digital platforms . We are not responsible for the privacy practices on these third-party websites or platforms (such as Bitmex, Coinbase, Binance and others). We do not have access to, nor control over these third parties’ cookies or similar technologies. Your access to our Services should not be affected if you do not accept cookies served by third parties.

To be able to use our Services, you can share with us the API keys to your trading data from some of the third party websites or platforms (such as Bitmex, Coinbase, Binance and others). Crypto Capital GmbH uses, processes, analyzes, stores and otherwise manages your trading data in accordance with the legal regulations of the EU General Data Protection Regulation (GDPR) and our Privacy- and Data Protection Policies. We are not responsible for the protection and security of your data on any of the third-party websites or platforms. If you have questions about the protection or use of your data by any third-party, please inform yourself about Privacy Policies of these companies on their respective websites.

7. How Do You Opt Out from Receiving our Emails?

You can choose not to receive COMMERCIAL emails, telephone promotions or other messages from Crypto Capital GmbH in the future by either
(1) following the “unsubscribe” instructions located near the bottom of each email or message, or
(2) you can email us at info@cryptocapital.ai.

Un-subscription from our (non-commercial) Data Reports, which are incorporated in our Services, is connected to your general subscription to the Services we provide, and may influence your further use of these Services.

8. How Do You Manage Your Personal Information?

If you would like to access, change, update and correct, your personal information that you have previously provided to us, access your transaction history, restrict or delete your personal information, or request to receive an electronic copy of your personal information (to the extent this right to data portability is provided to you by applicable law), you may do it through your personal account at our Services, by filling in the contact form or by contacting us per e-mail at info@cryptocapital.ai. Please mention or state in your request, what personal information you would like to have changed, suppressed from our databases, or otherwise managed. For your protection and the protection of your personal information, you will need to verify your identity (through verification of your email address) before we implement your request. We will only implement requests with respect to the personal information associated with a particular email address, and will respond to such requests in accordance with applicable law.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion of your personal information. In particular, when you make a subscription for any of our paid Services, you MAY NOT BE ABLE to change or delete the Personal Information provided until after the completion of such Services.

In addition, please note that your request DOES NOT ensure complete or comprehensive removal of your information, as, for example, after the revocation of your consent your trading data will be ANONYMIZED and further USED for the implementation of our Company’s Services.

9. Data Retention

We retain personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained and consistent with applicable law. The criteria used to determine our retention periods include:
The length of time we have an ongoing relationship with you and provide our Services to you (for example, for as long as you have an account with us or continue to use Crypto Capital GmbH Services);
Whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them);
or
Whether retention is advisable in light of our legal position (for example, in light of applicable statutes of limitations, litigation or regulatory investigations).

10. Is Your Information Protected?

We seek to protect your personal information and trading data with reasonable organizational, technological and physical safeguards commensurate to the sensitivity of the personal information. Although we take appropriate measures to safeguard your information, we cannot guarantee its absolute security. To further protect your data, we recommend that you use complex passwords for your accounts with us and for accounts with third parties, which are or may be linked to your account with us. Please do not use the same passwords you use for Crypto Capital GmbH Services for other services, websites or platforms, and do not share your password with unauthorized people. 11. International Transfers

Crypto Capital GmbH is headquartered in Berlin, Germany. The information you provide to us or that we obtain as a result of your use of our Services is collected in your country and subsequently transferred to Germany, or to another country in which we have facilities, affiliates, or our service providers.

Some countries that are not members of the European Economic Area (EEA) are recognized by the European Commission as providing an adequate level of data protection according to EEA standards (the full list of these countries is available here).
